Intellectual Property Policy

This policy explains the rules that apply on Mzya Shopping regarding intellectual property, including trademarks, logos, photographs, descriptions, creations, protected content, counterfeit products and infringements of third-party rights.

Responsible marketplace

Mzya Shopping prohibits counterfeit products, unauthorized use of brands or protected visuals, and any content that infringes intellectual property rights.

1. Purpose of this policy

This Intellectual Property Policy defines the rules applicable to the use of content, distinctive signs, visuals, works, trademarks, creations and products published or sold on Mzya Shopping.

It applies to all platform users, including sellers, customers, visitors, rights holders and any person reporting a potential infringement.

2. General principle

Mzya Shopping respects intellectual property rights and expects all users to do the same.

It is strictly prohibited to publish, sell, reproduce, distribute, use or exploit on the platform any content, product, trademark, visual, text, creation or other protected element without having the necessary rights, authorizations or licenses.

3. What may be protected?

The following elements may be protected, depending on their nature and the applicable law:

  • trademarks, trade names, logos and distinctive signs;
  • designs, models, packaging visuals and graphic elements;
  • photographs, videos, texts, descriptions and original creations;
  • catalogues, visual identities, editorial content and marketing materials;
  • graphic, artistic, digital or advertising works;
  • product names, visual identities and protected presentations.

4. Prohibited products and content

The following are prohibited on Mzya Shopping, in particular:

  • counterfeit products, copies, fraudulent imitations or unauthorized replicas;
  • listings using a protected trademark, logo or name without authorization;
  • product pages using photos, descriptions or content without permission;
  • content likely to create confusion with a brand or legitimate rights holder;
  • advertising materials, visuals or creations that infringe third-party rights;
  • any product or content that clearly infringes intellectual property rights.

5. Seller obligations

Each seller is solely responsible for the products, content, images, descriptions, documents and elements they publish on Mzya Shopping.

The seller guarantees that they hold all necessary rights to use and sell the content and products published in their store, and that they do not infringe trademarks, copyrights, designs and models or any other intellectual property right.

At the platform’s request, the seller must be able to provide any useful document proving the origin, authenticity, license, authorization to use or lawful nature of the content or product concerned.

6. Use of platform content

The content available on Mzya Shopping, including texts, logos, visuals, structures, pages, graphic elements, photos and presentations, may not be reproduced, copied, extracted, adapted or reused without prior authorization, except where expressly permitted by law.

7. Reporting an infringement

If you believe that any content, listing, product or store on Mzya Shopping infringes your intellectual property rights, you may submit a report to Mzya Shopping.

To help us process reports quickly, any user, buyer, seller, brand or rights holder may report a suspicious product directly from the product page, through the contact form, or by e-mail to the dedicated intellectual property address.

The report should be as precise as possible and include, where possible:

  • the identity of the rights holder or their representative;
  • complete contact details;
  • a description of the right being claimed;
  • the references of the content, product or store concerned;
  • useful URLs or screenshots;
  • available supporting documents, such as certificates, registrations, licenses or proof of ownership;
  • a good-faith statement confirming the accuracy of the information provided.

8. Processing of reports

Mzya Shopping may review any report received, request additional information, contact the seller concerned, request supporting documents, temporarily hide an offer, remove content, suspend a listing or take any other useful measure to limit risk or handle the dispute.

The platform assesses each situation on a case-by-case basis and may act without prior notice when the seriousness or clarity of the alleged infringement justifies it.

9. Measures that may be taken

In the event of a confirmed or seriously suspected infringement, Mzya Shopping may, in particular:

  • remove or disable the product or content concerned;
  • request changes to a product page or store content;
  • temporarily block certain features;
  • suspend or close a seller account;
  • hold certain operations linked to the disputed case;
  • refer the case to the competent authorities or organizations where necessary.

10. Abusive or bad-faith reports

Any notice or report that is intentionally inaccurate, misleading, abusive or made in bad faith may be rejected. Mzya Shopping reserves the right to take appropriate measures in the event of misuse of the reporting mechanism.

11. Marketplace role and responsibility of third-party sellers

Mzya Shopping is a marketplace platform allowing independent third-party sellers to present and offer their products to users.

Products published on Mzya Shopping are offered under the exclusive responsibility of the sellers concerned. Each seller is solely responsible for the legality, authenticity, compliance, origin, images, descriptions, trademarks used, prices, availability, delivery and after-sales service of their products.

Mzya Shopping does not manufacture, own, physically control or automatically certify all products published by sellers. However, in order to protect users, rights holders and the platform, Mzya Shopping reserves the right to review, hide, disable, remove or refuse any product, content or seller account in the event of doubt, report, non-compliance, suspected counterfeiting, unauthorized use of a trademark or violation of the law.

Mzya Shopping may request from the seller any useful supporting document, including purchase invoices, proof of origin, distribution authorization, certificate of authenticity, license or any document demonstrating the right to sell the product concerned.

In the event of a confirmed or seriously suspected violation, Mzya Shopping may suspend the seller account, remove the products concerned, keep the elements necessary to analyze the case and, where necessary, cooperate with the competent authorities, rights holders or legitimate representatives of the brands concerned.
